Hire Terms & Conditions

BETWEEN: Classy Loos Pty Ltd ACN 631 363 552         (“Classy Loos”)

AND: Hirer ___________________________ (“Hirer”)

(From this point on referred to collectively as “the Parties”)

 

RECITALS:

  1. Classy Loos agrees to hire and supply the Classy Loo to the Hirer for the Hire Term in accordance with the hire terms and conditions stated in this Agreement.  

 

TERMS OF AGREEMENT:
 

1. DEFINITIONS:

  1. Balance Payment: balance of the Hire Fee owing after payment of the Deposit

  2. Call out fee: $50 plus GST per hour for the travel, attendance and service of a Classy Loos representative 

  3. Classy Loo: means the portable trailer which includes two toilets, urinal, three vanities, deck, and all equipment and attachments.

  4. Cleaning Fee: $50 plus GST per hour of time spent cleaning by a Classy Loos representative 

  5. Deposit: amount payable upon booking as specified on Tax Invoice

  6. Hire Term: Length of time Hirer has hired the Classy Loos

    2. BOOKING & HIRE REQUIREMENTS

2.1 Upon booking the Classy Loo the Hirer must provide the following information: 

- The contact information of the Hirer (Name, phone, email)

- The date of the event

- The number of guests expected

- The address of the venue

- The name and phone number of the contact person on the day of the event.  

- Confirmation that there is clear access to a level spot for the loos.  

2.2 Within a week of the information being returned, Classy Loos will send the Hirer a Tax Invoice based on the information provided by the Hirer. 

2.3 A booking will not be confirmed until a deposit has been paid by the Hirer to Classy Loos. 

2.4 Classy Loos has the right to terminate this Agreement at any time should the Hirer breach this Agreement. 
 

3. DEPOSIT & CONFIRMATION OF BOOKING

3.1 Both the Deposit and Balance Payment, as well as with the Bond shall be the same as the amounts indicated on the sent Tax Invoice.  The Tax Invoice forms part of this Agreement. 

3.2 Classy Loos is not bound by this Agreement and the Classy Loo is not reserved by the Hirer until the Deposit is received by Classy Loos. 

3.3 Classy Loos is not bound by this Agreement to deliver the Classy Loo until Balance Payment has been received by Classy Loos. 

3.4 Hirer must pay the Balance Payment to Classy Loos on or before the Tax Invoice due date. 

3.5 The 25% deposit is composed of a 15% non-refundable booking fee.  These percentages pertain to the total booking amount. 
 

4. CANCELATION OF BOOKINGS

4.1 Classy Loos may cancel a book where: 

a. at any time there is:

    i. an Act of God

    ii. a breach of this Agreement by the Hirer

    iii. another situation beyond the control of Classy Loos which may affect Classy Loos ability to perform it’s obligations under this Agreement or presents any risks or danger to Classy Loos representatives.  

b. a Deposit paid to Classy Loos from the Hirer but the Balance Payment has not been received by the date stated on the Tax Invoice.  In this event Classy Loos has the right to deem the failure to pay the Balance Payment as a “cancellation” by the Hirer. 

HIRER CANCELATION

4.2 Hirer may cancel the booking at any time however if the cancelation occurs 31 days or less prior to the event date, 50% of the total invoice amount will be forfeited and the remaining 50% will be refunded. If cancelations occur 91 days or more prior to the event all payments will be refunded less the 15% non-refundable booking fee.  If cancelations occur 7 days or less prior to event date, 75% of the total invoice amount will be forfeited and the remaining 25% will be refunded.  If the cancelations occur 48 hours or less prior to the event, the full invoice amount will be forfeited.  If there is a cancelation after the event has already had a change of date the full 25% deposit will be forfeited.  

 

5. GENERAL OBLIGATIONS OF CLASSY LOOS TO HIRER

CLASSY LOOS SHALL:

5.1 Deliver the Classy Loo clean and in good working order. 

5.2 Deliver the Classy Loo to the Hirer for the stated Hire Term and the location stated on the Booking Form. 

5.3 Pick up the Classy Loo at the end of the Hire Term. 
 

6. GENERAL OBLIGATIONS OF HIRER TO CLASSY LOOS

6.1 The Hirer agrees that they, or their representatives, or their guests, or any other person at the premises shall not cause or allow any of the following:

    i. moving the Classy Loos in any circumstance without Classy Loos permission. 

    ii. smoking, or using any illegal drugs or dangerous substances inside the Classy Loo. 

    iii. more than 1 adult and 1 child inside each cubicle at any one time.

    iv. mistreating or damaging the interior or exterior of the Classy Loo, which includes overuse of toilets and vanities.

    v. attempting to repair damages of the Classy Loos. 

    vi. attaching anything onto the interior or exterior walls without the permission of Classy Loos. 
 

7. DELIVERY FEE

7.1 If a delivery fee applies is will be quoted to the Hirer on the Tax Invoice. 

 

8. AUTHORITY TO USE CLASSY LOOS AT THE PREMISES

8.1 It is completely the responsibility of the Hirer to identify and obtain any permission, license or authority required for the placement of the Classy Loo on the premise from the relevant people and/or authorities. 

8.2 If there are fees associated with the placement of the Classy Loo on the premise it is completely the responsibility of the Hirer to identify and pay those fees prior to the delivery of the Classy Loo.  Classy Loos takes no responsibility for these associated fees. 

9. IMPACT OF CLASSY LOO ON THE PREMISE

9.1 The Hirer acknowledges that the Classy Loos representative may cause damage to the premise by the placement of the Classy Loo due to the weight of the Classy Loo, as well as the turning of the towing vehicles wheels.  These damages to landscaping feature include, but are not limited to grassed areas, gravel paths, tree branches, and gardens.

9.2 Classy Loos will take all reasonable measures to limit any damages to landscaping where it is possible to do so. 

9.3 In all circumstances the Hirer shall indemnify and hold harmless in full Classy Loos from any claims by the Premises owners or occupiers for repair to any landscaping features. 
 

10. PLACEMENT OF CLASSY LOO AND SPECIFICATIONS FOR ACCESS AND SPACE

10.1 The Classy Loos will be placed at the Premise at the nominated location by the Hirer. 

10.2 The dimensions of the Deluxe Classy Loo are approximately 3.6m high, 2.4m wide, 5m long with a wet weight of approximately 2500 kg.  The dimensions of the Classy Mini Loos are approximately 3.3m high, 2.1m wide, 4m long with a wet weight of approximately 2000 kg.  

10.3 It is the responsibility of the Hirer to ensure there is adequate access at the relevant times to deliver and remove the Classy Loo to the nominated location. 

10.4 If the Classy Loos gets stuck and a tow truck is required, all expenses will be covered by the hirer.  To reduce the chances of the trailer getting bogged, clear access to a level spot on dry ground is required.  
 

11. HIRER GRANT OF INDEMNITY TO CLASSY LOOS FOR INJURY, LOSS AND DAMAGE

11.1 The Hirer understands that access into the Classy Loo is via steps.  While these steps will be fastened to the ground and/or the Classy Loo, it is the responsibility to ensure that:

    i. only people who are physically capable to access the Classy Loo access it. 

    ii. any person under the influence of any substance does not utilize the Classy Loo unless assisted by someone unaffected by a substance.

    iii. the steps do not become wet and/or slippery by way or regular inspection and necessary cleaning/drying of them during the Hire Term.  If the Hirer has hired a Butler Service from Classy Loos then it will be the responsibility of the Classy Loos Butler to ensure the steps remain dry and safe. 

11.2 Classy Loos recommends that all guests utilizing the Classy Loo steps use the handrails and handles provided.

11.3 The Hirer shall indemnify in full Classy Loos and hold it harmless in respect of any loss, damage, cost (including legal costs on a solicitor-client basis), expense, personal injury, legal proceedings of a criminal or civil nature arising out of or in relation to the Classy Loo during the Term of Hire and the delivery/collection of the Classy Loo to/from the Premises claimed by the Hirer or a third party other than that arising out of the negligence of Classy Loos. 

11.4 The Classy Loo is not wheelchair accessible.  It is the full responsibility of the Hirer to ensure that there are wheelchair accessible toilets available on the Premises to any guest that may require them during the Hire Term. 
 

12. MAKE GOOD AND REPAIR FOR DAMAGE AND/OR REPLACEMENT

12.1 The Hirer shall be liable to pay in full any costs incurred by Classy Loos for the immediate and urgent replacement and/or repair of any damage to the Classy Loo due to damages that incur whilst in the custody and control of the Hirer during the Hire Term. 

12.2 If urgent repairs are needed and the Hirer calls Classy Loos any time during the Hire Term, the Hirer may be charged and required to pay a Call Out Fee plus a Travelling Fee and/or where necessary, all costs associated with the services of a Tradesperson to attend the Premises to repair the Classy Loo. 

12.3 In order to cover costs or losses, the Damage Cover Fee (or part of it) may be forfeited to Classy Loos if any damages occur to the Classy Loos.

12.4 Hirer is responsible for all damage, theft, and non-return of Classy Loo. 
 

13. CLEANING OF THE CLASSY LOOS

13.1 Classy Loos will clean the Classy Loos and empty all rubbish bins inside the Classy Loos at the end of the Hire Term. 

13.2 An extra Cleaning Fee may be charged to the Hirer in the event that the Classy Loos is found at the end of the Hire Term to be requiring additional cleaning, beyond what would reasonably be expected in the circumstances.  
 

14. HIRERS LIGHTING AND ELECTRICITY RESPONSIBILITIES

14.1 The Classy Loos lights and fans are operated by batteries, located under the male side vanity.  It is the responsibility of Classy Loos to instruct the Hirer on how to turn on the lights and fans at the beginning of the event and how to turn them off.  

14.2 No guest or unauthorized person must tamper with any of the switches or equipment under the male side vanity.  Any damages incurred because of this will be charged to the Hirer. 

14.3 Classy Loos will deliver the Classy Loo with fully charged batteries which will enable lights and fans to be operational for up to 12 hours.
